- 半直接民主制における国民発案・国民投票制度の比較研究
武藏 勝宏
今年度は、住民投票(国民投票)と住民発案(国民発案)を中心に、各国の制度と日本の制度の比較検討を中心に文献研究と実証分析を行った。まず、住民投票に関しては、直接民主制を地方自治レベルで制度として採用しているアメリカの直接民主制度と日本の住民投票条例に基づく住民投票の比較研究を中心に実施した。具体的には、 日本の地方自治体における諮問型住民投票の制度と実態を分析し、地方自治における住民投票の果たすべき役割とその実現のための方法を考察した。研究の方法としては、1996年から2020年までに、市町村合併以外の政策に関するテーマで実施された48件の住民投票の事例を対象に、住民投票が実施に至る政治的な要因を分析した。分析の結果、約半数の住民投票が、首長が推進する政策に対して、議会が賛成する状況に住民が反発する場合に実施されたことがわかった。他方で、全体の約3分の1の住民投票が、首長の政策と議会の主張が対立する場合に実施された。成立した住民投票の約半数で、首長の主張が住民投票によって否定されており、首長の政策が撤回された事例も少なくない。以上のことから、住民投票は、議会のチェック機能を補完するとともに、首長と議会の対立に決着をつける機能を有すること、さらに、住民の民意を政策決定過程の中に反映させるという役割も有していることを指摘した。次に、住民発案については、国レベルで国民発案が制度化されているスイスやイタリアなどの制度を検討したうえで、日本の住民発案の事例について、1999年の地方分権一括法の公布の前後を比較し、日本の地方自治体における住民発案の内容が住民投票条例や市町村合併条例などに重点がシフトし、市民の政治参加や政治的影響力が増加していることを明らかにした。, 日本学術振興会, 科学研究費助成事業, 2020/04 -2023/03, 基盤研究(C), 同志社大学 - Comprehensive Analysis of the Expansion and the Advancement of Lawyering in Criminal Fields

This research has tried to explore the situation of (1) the expansion of lawyering related to criminal justice into crime victim assistance and other new fields and (2) the advancement of criminal defense lawyering in terms “zealous advocacy” and to analyze their challenges for the development in the future. Data have been collected through (1) interviews of 78 attorneys each of which lasted one and a half hours on the average and (2) 914 usable responses to a web survey conducted with a random sample of attorneys in the entire country. Data analysis has so far focused on the advancement of criminal defense lawyers, and interim reports have been presented at two international academic conferences, two domestic academic conferences, a symposium issue in a domestic academic journal, and a series of articles in a domestic academic journal. The purpose of this study is to examine the procedure and function of screening and approval of statutory instruments in the British House of Lords, and to examine the effectiveness of the control over the delegated legislation by the parliament under the bicameral system. In the UK, the Secondary Legislation Scrutiny Committee of the House of Lords plays an important role such as conducting the substantive political examination of a delegated order, however, there is no superiority in the House of Commons in the decision to approve statutory instruments. As a result, there is a delay in the enactment of administrative legislation due to the disagreement between the two houses. The Japanese parliamentary politics is in a confusion state. Our study is going to research the measures that dissolve and overcome this "confusion state" through a investigation of the intersection of "a dynamic theory" and "a normative theory" about the bicameral system. A normative theory does predominance in a dynamic theory in Italy and France, and it seems to be tied to an active argument over the system reform in two countries. In contrast, we had an impression that "a dynamic theory" did predominance in U.K., Germany, and Australia. The legislative activity in the Japanese Diet was confused as a result of the appearance of the "twisted Parliament". This study tries to clarify a method to overcome the situation, while investigating any institutional and political causes of this confusion.
