- Constructing the principles and the system of Medical Law as "Law of Interpersonal Relationship": In the Light of Medical Neglect Cases

In this study we put forth the theory of “Guarantors for Children”, which enables Criminal Law, Civil Law and Child Welfare Law to cooperate to function as “Ex-ante Adjustment Law” so as to prevent medical neglects caused by incidents of patient-doctor-parent “Relationship Dysfunction”. Under the conventional dualism that divides the responsibility to nurture children into the primary and secondary ones and attributes them to the parents and to the nation, respectively, it is likely to lead to inflexibility and insufficiency to identify either the parents or the nation mutually exclusively as the “Guarantors for Children”. We conducted a research concerning the medical neglect of child patients, cases of which we proposed to be regarded in essence as resulting from the dysfunction of interpersonal relationships between children, parents and medical profession. This research study was designed to capture the idea of "Welfare Community," a community-based social work practice and the governing system that enables the social work process, through international comparison. It also aims to identify the appropriate social work education that would contribute to the establishment of "Welfare Community." During the research period, we have held study group periodically, and we have organized several workshops and a seminar which were open to the public. Besides, we have conducted interviews with social workers in selected communities, and we have also conducted a survey with schools of social work in Japan and overseas. With the purpose of constructing an East Asian model of Social Work, research on theory and practice was conducted with a focus on the relationship between social work and national culture. First, research was conducted in Japan, Korea and China, which looked at the relevancy of demographic factors, views on the care of elderly parents, and family cohesion. Results involved the development of a scale to measure elder parent care in East Asia. Using the factor construct model, the concept's validity was statistically supported. Results showed that Confucianism, which values the care of elderly parents is a variable that cannot be ignored, and that it is possible to presume that age and recognition of family cohesion are both relevant in views regarding elder parent care. Seeing how these results are embodied in social worker's practice behavior will be an issue for future research. In addition, taking a look at elderly lifestyles, culture, awareness and needs, while employing the concept of social support, a survey was conducted in Japan, Korea and China in order to understand the awareness among the elderly toward support(in their daily lives). Results confirmed that family is the most important source of support for the elderly, and is most highly selected. At issue next is to consider the construction of a model of theory and practice in assistance to the elderly, and its possible application. Next, research looking into the cultural foundation of social work theory and practice and its special characteristics was carried out, toward the construction of a social work model. Research that targeted staff of social work facilities for the elderly in Korea and Japan, obtained fruitful results relating to individual conceptions, Confucian culture, and family culture. (1)The project started with the 'East Asian Model' by identifying similarities and differences in community development (CD) in Japan and Korea, and then went on to compare with CD in Great Britain (GB) as an example of Liberal model, the Netherlands as a Corporative model and Sweden as a Social Democrats model. Three subjects were focused on to investigate; 1) Public-voluntary partnership, 2) Isolated problems in the community and neighborhood support networks, and 3) community work and social work. (2)Through the comparison of CD in Japan and Korea with those of Western countries, larger differences were identified both in the quality and the quantity. This might not be attributed only to the geographical aspects of East Asia. Rather, it might be caused by historical conditions as the late comer to the welfare state or society. (3)While Japan and Korea have been still on the stage of public-control and voluntary-dependent relations, GB has got Compacts between the public and voluntary sectors and local strategies of partnership based upon the equal relationships, and Sweden has got the historical consensus model and commitments to the voluntary sector under the public responsibility. Netherlands has got the consensus model under the complementary principle. (4)While Japan and Korea have been coping with isolated problems making neighborhood support networks, GB has been trying to collaborate between the public and voluntary sectors as the issues of social inclusion, and Sweden has got public care networks for the elderly. Netherlands's voluntary body SWOL has attracted attention to tackle with isolated problems of the elderly. (5)Community work and social work has differed between Japan and Korea. CD in GB has covered broader fields, and municipalities in Sweden have placed lots of social workers.
